Terms and Conditions
Effective date: IndefinitelyThese Terms and Conditions apply to the LVWF Extract Results Program operated by Las Vegas Worm Farm, referred to below as “LVWF,” “we,” “us,” or “our.”
By submitting an application, accepting a place in the program, picking up program supplies, or participating in the program, you confirm that you have read and agree to these terms.

1. About the Program
The LVWF Extract Results Program is a four-week product-testing program for local Las Vegas gardeners.
The purpose of the program is to learn:

  • Whether gardeners notice visible results
  • What types of results they notice
  • How quickly results appear
  • How easy the product is to use
  • What problems, concerns, or hesitations gardeners experience
  • What could make the product or program better.

Participants receive LVWF Extract and certain testing supplies at no cost in exchange for completing the required applications, photographs, progress updates, and final report.
Positive results are not required. Honest and complete participation is required.
This program is not a random drawing, lottery, or sweepstakes. The completion reward is earned by completing the program requirements.
No purchase is required.

2. Eligibility
To participate, you must:

  • Be at least 18 years old
  • Be a real individual participating under your own identity
  • Live within the Las Vegas area
  • Be able to pick up supplies from the location provided by LVWF
  • Have an active plant or garden area available for testing
  • Be able to begin within the time stated in your application
  • Be able to complete the full four-week program
  • Meet all qualification requirements
  • Agree to these Terms and Conditions

Unless LVWF approves otherwise, only one participant may enter per household.
LVWF owners, employees, contractors, and members of their immediate households may not participate unless LVWF specifically approves their participation and clearly discloses their relationship wherever their feedback is used.

3. Application Information
All application information must be accurate and complete.
You may be removed from consideration or participation if LVWF determines that you:

  • Provided false or misleading information
  • Submitted more than one application
  • Used someone else’s identity
  • Are not a local participant
  • Do not have an appropriate test plant or garden area
  • Cannot meet the weekly requirements
  • Cannot begin within the required period
  • Attempted to avoid or manipulate the qualification process

Submitting an application does not guarantee acceptance.

4. Waitlist
Applicants may be placed on the waitlist when:

  • The current program group is full
  • Additional information is needed
  • LVWF believes a future testing group would be a better fit

Being placed on the waitlist is not a promise or guarantee of future acceptance.
Waitlist order may be based on availability, garden type, testing needs, readiness to begin, ability to complete the requirements, or other program needs. The waitlist may not operate strictly in the order applications were received.
LVWF may contact a waitlisted applicant when a space becomes available. A waitlisted applicant may be required to answer updated qualification questions before being accepted.

5. Conditional Acceptance
An acceptance message means that LVWF has temporarily reserved a program space for you.
Your place is not fully active until you complete all required activation steps by the deadline stated in your acceptance email. These steps may include:

  • Confirming your contact information
  • Selecting your test plant or garden area
  • Completing the baseline form
  • Uploading the required starting photographs
  • Scheduling or completing supply pickup
  • Confirming that you have reviewed the application instructions

LVWF may release your reserved place to another applicant if you do not complete the activation steps by the deadline.
Your acceptance may also be withdrawn if LVWF later discovers that your application information was inaccurate or that you do not meet the program requirements.

6. Before You Apply
This program requires consistent participation.
Before applying, make sure you can:

  • Begin immediately if accepted
  • Use the same plant or garden area for four weeks
  • Apply the product once each week
  • Complete a short online update once each week
  • Upload at least one clear photograph every week
  • Take the photographs from approximately the same position and distance
  • Continue normal watering, compost, and mulch practices
  • Avoid prohibited chemical products during the test
  • Report other products or major garden-care changes
  • Return your reusable bottle as required
  • Complete the final progress report

Please do not apply merely to receive free products.
Applicants who do not complete the initial activation steps or early milestones may be removed so the space can be offered to another gardener.

7. Program Length and Schedule
The program is expected to last four weeks, or approximately 42 days.
The normal schedule includes:

  • Baseline submission
  • Starting photographs
  • Weekly product applications
  • Weekly progress photographs
  • Weekly progress updates
  • Final photographs
  • Final progress report
  • Optional video testimonial

LVWF may make reasonable scheduling changes due to weather, product availability, holidays, safety concerns, technical problems, or other circumstances.
You are responsible for knowing your deadlines even if an email or text reminder is delayed, blocked, sent to spam, or not received.

8. Product Application Requirements
Participants will normally receive 32 ounces of LVWF Extract for each weekly application.
Unless LVWF provides different written instructions, participants must:

  • Apply the product once per week
  • Apply it to the soil
  • Use it on the same test plant or garden area
  • Use the amount provided
  • Follow all storage and application instructions
  • Avoid applying it in a way that conflicts with LVWF instructions
  • Keep the product container properly closed and stored

Do not drink or ingest the product.
Do not intentionally spray the product into the eyes, mouth, or face of any person or animal.
While product is safe, keep the product and equipment away from children and pets when not being actively supervised.
Do not use the product for any purpose other than its intended garden or soil application.
Do not combine the product with another substance unless LVWF has stated that the combination is appropriate.
Stop using the product and contact LVWF if you notice an unexpected odor, container swelling, leaking, unusual pressure, damaged packaging, or another condition that causes concern.

9. Normal Garden Care
Participants should continue their normal:

  • Watering
  • Compost use
  • Mulch use
  • Garden maintenance

Participants must report major changes that may affect the results, including:

  • Changes in watering
  • New shade structures
  • Plant relocation
  • Repotting or transplanting
  • Major pruning
  • New compost or amendments
  • Fertilizer use
  • Pest treatments
  • Irrigation problems
  • Heat damage
  • Animal damage
  • Plant disease
  • Storm or wind damage

Using other products does not automatically make a participant ineligible unless the product is prohibited or the use is not reported.

10. Prohibited Chemical Products
During the testing period, participants must not use the following in the test area:

  • Chemical fertilizers
  • Herbicides
  • Chemical pesticides
  • Other prohibited products identified by LVWF

A participant who uses one of these products must report it immediately.
LVWF may remove the participant from the program or exclude some or all of the participant’s results if the product could affect the accuracy or usefulness of the test.

11. Weekly Photographs
Weekly photographs are required.
Photographs must:

  • Show the actual test plant or garden area
  • Be taken by the participant or with the participant’s permission
  • Be reasonably clear
  • Be taken from approximately the same location and distance each week
  • Accurately represent the plant or garden at that time
  • Not use stock photography
  • Not show a different plant as though it were the original test plant
  • Not be altered to exaggerate or hide results

Normal cropping, rotation, brightness correction, and minor image cleanup are allowed if they do not misrepresent the plant’s condition.
Artificial intelligence, major filters, object replacement, artificial growth, or other misleading edits are not allowed.
LVWF may ask for an additional photograph when the submitted image is unclear or cannot be compared with earlier images.

12. Weekly Updates
Each weekly update must be submitted by the stated deadline.
Weekly questions may ask whether:

  • The Extract was applied
  • The full amount was used
  • The same plant or area was treated
  • A visible change was noticed
  • The product was easy to use
  • A problem or concern occurred
  • Another product was used
  • Normal garden care changed

Most questions will use simple Yes, No, or Not Sure answers. Optional explanation boxes may also be provided.
Participants must answer honestly.

13. Late or Missed Milestones
LVWF may allow a limited grace period for a late submission.
A milestone may be marked missed when:

  • The form is not completed
  • The required photograph is missing
  • The photograph does not show the correct test area
  • The participant cannot confirm that the product was applied
  • The submission is made after the permitted grace period

Technical trouble does not automatically excuse a missed deadline. Contact LVWF before the deadline, when possible, if the website or upload system is not working.
LVWF may approve reasonable exceptions individually, but is not required to approve every exception.

14. Removal From the Program
LVWF may remove a participant for reasons including:

  • False application information
  • Missed milestones
  • Repeated late submissions
  • Failure to upload usable photographs
  • Failure to pick up supplies
  • Failure to return reusable containers
  • Use of prohibited chemical products
  • Unsafe product use
  • Product resale
  • Harassment, threats, or abusive behavior
  • Fraudulent or misleading photographs
  • Allowing another person to complete the program under the participant’s identity
  • Failure to follow written instructions
  • Conduct that threatens the integrity or safety of the program

A removed participant will no longer receive free testing supplies and will not earn the completion reward.
LVWF may also exclude individual submissions from its results without removing the participant when a specific submission cannot be verified or fairly compared.

15. Voluntary Withdrawal
You may stop participating at any time.
To withdraw, contact LVWF using the contact information provided in your program emails.
A participant who voluntarily withdraws before completing all required milestones will not earn the completion reward.
Previously submitted information may still be retained for program records, safety, fraud prevention, and legal compliance.
LVWF will not present an incomplete participant result as though the participant completed the full program.

16. Results Will Vary
Gardens, plants, soils, weather, water quality, irrigation systems, sun exposure, temperatures, plant varieties, pests, diseases, and gardening practices vary.
LVWF does not guarantee that:

  • A participant will see a visible change
  • A plant will grow faster
  • Leaves will become greener
  • Heat stress will improve
  • Flowering or fruit production will increase
  • A damaged or unhealthy plant will recover
  • Results will appear within a particular number of days
  • One participant’s results will be typical for another gardener

The purpose of the program is to observe and document real experiences.
The product is not a substitute for proper watering, suitable soil, shade, pest management, plant care, or other appropriate garden care.

17. Plant Damage and Gardening Risks
Gardening involves natural risks, including plant stress, plant death, pests, disease, weather damage, irrigation failure, heat exposure, and unexpected reactions to products or changes in care.
Participants are responsible for:

  • Selecting an appropriate test plant or area
  • Following the instructions
  • Monitoring their plants
  • Providing suitable water and normal care
  • Stopping application and contacting LVWF when a serious concern occurs
  • Protecting themselves while gardening and using application equipment

To the fullest extent allowed by law, LVWF is not responsible for indirect, incidental, special, or consequential losses related to participation, including the loss of plants, crops, flowers, fruit, expected harvests, or garden value.
Nothing in these terms is intended to exclude responsibility that cannot legally be excluded.

18. Honest Feedback
Participants must provide their real opinions and experiences.
LVWF does not require:

  • A positive result
  • A positive testimonial
  • A recommendation
  • A five-star review
  • A public social-media post

The completion reward is based on completing the required milestones—not on expressing a positive opinion.
Negative, mixed, uncertain, and positive feedback are all permitted.
LVWF will not knowingly change a participant’s feedback to make a negative experience appear positive.

19. Public Reviews and Social-Media Posts
Participants are not required to publish a review or social-media post.
When a participant voluntarily posts publicly about the program or product, the participant must clearly state that:

  • The product was provided at no cost, or
  • The participant took part in the LVWF Extract Results Program, or
  • The participant received free product or an earned product reward

A disclosure must be easy for viewers to notice and understand.
Examples include:

  • “LVWF provided this product to me for free as part of its testing program.”
  • “I participated in the LVWF Extract Results Program and received free product.”
  • “Gifted by Las Vegas Worm Farm for testing.”

LVWF may ask a participant to correct or add a disclosure when a public post does not clearly explain the free-product relationship.

20. Permission to Use Submitted Content
By participating, you confirm that you own or have permission to submit the photographs, videos, written responses, and other content you provide.
You grant LVWF a nonexclusive, royalty-free, worldwide license to:

  • Store the submitted content
  • Review and analyze it
  • Display it on LVWF websites
  • Use it on social media
  • Use it in emails
  • Use it on product pages
  • Use it in advertisements
  • Use it in printed materials
  • Create before-and-after comparisons
  • Create slideshows or time-lapse presentations
  • Include it in educational materials
  • Share program summaries and case studies

LVWF may identify you using your first name and last initial.
LVWF will not publicly display your private email address, telephone number, street address, or full last name without separate permission.
LVWF may crop, resize, organize, caption, or shorten submitted content for clarity and format. LVWF may correct minor spelling or grammar errors but will not knowingly change the meaning of your statement.
LVWF may place multiple weekly photographs into a slideshow, timeline, collage, or before-and-after comparison.
This permission does not require LVWF to use your content.
You may request that LVWF stop using your content in new marketing materials. LVWF will make reasonable efforts to honor the request, but previously printed, published, scheduled, distributed, or archived materials may remain in use.

21. Disclosure When LVWF Uses Testimonials
When LVWF uses a participant’s testimonial, review, photograph, video, or results in advertising, LVWF may include a disclosure explaining that the participant:

  • Received free testing product
  • Received a sprayer or other supplies
  • Participated in the LVWF Extract Results Program
  • Became eligible for a completion reward

LVWF may also include language explaining that results vary and that the displayed result is one participant’s experience.

22. Completion Requirements
To successfully complete the program, a participant must normally:

  • Complete the baseline form
  • Upload the required starting photographs
  • Apply the Extract weekly
  • Complete every required weekly update
  • Upload every required weekly photograph
  • Complete the final report
  • Upload the required final photographs
  • Return reusable bottles “if required”
  • Follow the program rules
  • Remain eligible through the end of the program

The final video testimonial is strongly encouraged but is not required unless the application page clearly states otherwise before participation begins.
LVWF will determine completion based on its program records.

23. Completion Reward

A participant who successfully completes every required milestone will earn:
One gallon of LVWF Extract per month for 12 consecutive months.
This is equal to approximately four 32-ounce weekly applications per month.
The reward:

  • Begins after LVWF confirms successful completion
  • Requires local pickup
  • Is limited to one gallon per month
  • Is intended for the participant’s personal garden use
  • Cannot be sold or exchanged
  • Cannot be transferred to another person
  • Has no cash value
  • Cannot be combined into a cash payment
  • Does not automatically renew after 12 months

Participants must follow LVWF’s bottle-return and pickup procedures.
Unless LVWF states otherwise in writing:

  • Missed monthly pickups do not roll over
  • Multiple months cannot be collected in advance
  • Unclaimed product is forfeited
  • A participant must remain respectful and follow normal pickup rules
  • The reward ends after 12 consecutive monthly reward periods

LVWF may provide the monthly reward as one gallon or as four 32-ounce portions.
Packaging, container type, pickup dates, and product format may change when reasonably necessary.
Participants are responsible for any personal tax obligations associated with the reward, if applicable.

24. Product and Supply Availability
Program supplies are subject to reasonable availability.
LVWF may:

  • Change the pickup schedule
  • Substitute a comparable sprayer or container
  • Delay a refill when product safety or quality is uncertain
  • Replace damaged packaging
  • Modify storage or return procedures
  • Pause distribution during unsafe weather or operational interruptions

LVWF will make reasonable efforts to provide the planned amount of Extract, but temporary delays do not automatically create a cash entitlement.

Bottle Return and Pickup Procedures
Program supplies and completion rewards are available by local pickup only. Delivery is not included unless LVWF agrees otherwise in writing.
During the four-week trial:

  • Participants must pick up each weekly 32-ounce portion during the pickup window provided by LVWF
  • Participants must return the reusable bottle issued for the prior week before receiving the next portion
  • Returned bottles must be empty, capped, and free from chemicals, pesticides, fertilizers, oils, soaps, or other substances
  • LVWF may refuse a container that is contaminated, damaged, unsafe, or not suitable for reuse
  • Lost, unreturned, or damaged containers may need to be replaced before additional Extract is provided
  • Missing a pickup may cause the related weekly application or milestone to be marked late or missed
  • Reasonable exceptions may be approved by LVWF individually

LVWF may request identification or other confirmation before releasing program supplies.
Unclaimed product is forfeited after the applicable pickup period ends
LVWF may reasonably change pickup days, pickup windows, container types, or return instructions because of holidays, weather, safety, product quality, or operating needs.
When practical, LVWF will provide advance notice of material changes.

25. No Employment or Business Relationship
Participation does not make you:

  • An LVWF employee
  • An independent contractor
  • A sales representative
  • A spokesperson
  • A partner
  • A joint venture
  • An agent of LVWF

The free product, supplies, and completion reward are program benefits and are not wages.
Participants may not claim to officially represent LVWF without written permission.

26. Privacy and Contact Information
LVWF may collect:

  • Your name
  • Email address
  • Mobile telephone number
  • ZIP code
  • Application answers
  • Garden information
  • Photographs and videos
  • Weekly responses
  • Product-use information
  • Website submission records
  • Program status
  • Pickup and reward records

This information may be used to:

  • Process your application
  • Determine eligibility
  • Operate the program
  • Send required program messages
  • Track milestones
  • Provide support
  • Prevent fraud
  • Evaluate product performance
  • Create aggregated program reports
  • Use approved participant content in marketing

Required program emails are different from optional promotional marketing.
You do not have to join LVWF’s general marketing list to participate. Promotional email consent should be collected separately.
Program information will also be handled under LVWF’s posted Privacy Policy.

27. Electronic Communications
By applying, you agree that LVWF may send program-related communications by email and, when provided and permitted, by telephone or text message.
Program communications may include:

  • Application status
  • Waitlist notices
  • Acceptance notices
  • Pickup details
  • Instructions
  • Deadline reminders
  • Missing milestone notices
  • Safety notices
  • Completion status
  • Reward information

You are responsible for providing accurate contact information and checking your email folders.
Electronic acceptance of these terms, including checking the required box and submitting the form, is intended to show your agreement to the program requirements.

28. Program Changes, Suspension, or Cancellation
LVWF may reasonably change, pause, extend, or cancel the program when necessary because of:

  • Safety concerns
  • Product-quality concerns
  • Extreme weather
  • Supply shortages
  • Website or software failure
  • Fraud or manipulation
  • Legal or regulatory requirements
  • Events outside LVWF’s reasonable control

LVWF will make reasonable efforts to notify affected participants.
When practical, LVWF may offer a substitute schedule, replacement milestone, or comparable solution. LVWF is not required to provide cash instead of program products or rewards.
Changes will not be made for the purpose of turning honest negative feedback into positive feedback.

29. Program Integrity
LVWF may review submissions to protect the fairness and accuracy of the program.
LVWF may investigate:

  • Duplicate applications
  • False identities
  • Reused or stock photographs
  • Artificially edited images
  • Photographs belonging to another person
  • Misrepresented application dates
  • Missing product pickups
  • Unreported chemical use
  • Attempts to obtain supplies without participating

LVWF’s decision regarding participation status, milestone completion, and reward eligibility will be final unless LVWF determines that an error occurred.

30. Limitation of Liability
To the fullest extent permitted by law, LVWF’s total responsibility arising from the program will not exceed the value of the program products and supplies provided or promised to the participant.
LVWF will not be responsible for:

  • Lost profits
  • Lost crops
  • Lost harvests
  • Lost business opportunities
  • Indirect or consequential damages
  • Internet or upload failures
  • Missed emails
  • Conditions outside LVWF’s control
  • Damage caused by ignoring product instructions
  • Damage caused by mixing the product with unapproved substances
  • Damage caused by improper storage or application

These limitations do not apply where they are prohibited by law.

31. Participant Responsibility
You are responsible for losses or claims caused by:

  • Content you submit without permission
  • False or misleading information
  • Unsafe or prohibited product use
  • Your violation of another person’s privacy or intellectual-property rights
  • Reselling program supplies
  • Claiming to represent LVWF without permission

32. Governing Law
These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
Any dispute that cannot be resolved informally will be handled in a court with proper jurisdiction in Clark County, Nevada, unless applicable law requires otherwise.
Before filing a legal claim, both parties agree to make a reasonable attempt to resolve the matter directly.

33. Severability
If one part of these terms is found invalid or unenforceable, the remaining terms will continue to apply to the fullest extent allowed by law.

34. No Waiver
If LVWF does not immediately enforce one part of these terms, that does not permanently waive LVWF’s right to enforce it later.
Approving an exception for one participant does not require LVWF to approve the same exception for another participant.

35. Entire Program Terms
These Terms and Conditions, the qualification page, the product instructions, the acceptance email, the Privacy Policy, and any written program updates provided by LVWF make up the complete program requirements.
If two instructions conflict, the most recent written instruction from LVWF will control, except when applicable law requires otherwise.
